| Abstract | กล่องสุ่ม (Mystery box) คือ กล่องที่มีการนำสินค้าหลายๆ อย่าง คละแบบ/ราคา ใส่ไว้ในกล่อง และมีการนำมาขาย โดยที่ผู้ซื้อไม่ทราบว่าสินค้าในกล่องมีอะไรบ้าง รู้เพียงราคาของกล่องที่ซื้อว่าเท่าไรเท่านั้น ซึ่งตามหลักแล้วถือเป็นกลยุทธ์ในการทำการตลาดแบบหนึ่ง เป็นการกระตุ้นยอดขายและทำให้ลูกค้ารู้จักร้านมากขึ้น ทุกวันนี้หลายคนคงรู้จักกล่องสุ่มมากขึ้น เพราะมีการโฆษณาขายอยู่บนโลกออนไลน์อย่างแพร่หลาย และบวกกับคุณสมบัติของกล่องสุ่มที่ทำให้ผู้ซื้อ ได้ลุ้นว่าจะได้ของอะไรบ้าง ซึ่งตรงกับนิสัยคนไทยบางส่วนที่ชอบการเสี่ยงโชค เสี่ยงดวง ทำให้กล่องสุ่มได้รับความนิยมอย่างรวดเร็ว มีอินฟลูเอนเซอร์หรือดาราหลายคนหันมาขายกล่องสุ่ม แต่อย่างไรก็ตามก็มีข่าวออกมาอยู่เป็นระยะว่ามีผู้บริโภคจำนวนไม่น้อยที่โดนหลอกลวงจากกล่องสุ่ม เนื่องจากมีการชวนเชื่อว่าซื้อไปแล้วในกล่องมีโอกาสได้ของราคาแพง มีโอกาสสร้างกำไรจากกล่องสุ่ม เสมือนเป็นการพนันขันต่อที่มีทั้งคนได้และคนเสีย จึงเป็นที่สงสัยกันมากว่า ตกลงกล่องสุ่มที่มีอยู่เต็มไปหมดในโลกออนไลน์ เป็นการขายสินค้าที่ผิดกฎหมายหรือไม่ ปรากฏตามข่าวสารสังคมออนไลน์พบว่า ดารา นักแสดง และอินฟลูเอนเซอร์บางรายจัดให้มีการเล่นการพนันกล่องสุ่มสินค้า อันเป็นการเล่นการพนันที่เจ้าพนักงานผู้ออกใบอนุญาตตามกฎหมายว่าด้วยการพนันไม่สามารถออกใบอนุญาตให้ได้ เพราะการเล่นนั้นมีลักษณะเป็นการเสี่ยงโชคต่อการได้หรือเสียประโยชน์หรือยังเข้าข่ายเป็นการจัดให้มีการแถมพกหรือรางวัลด้วยการเสี่ยงโชคโดยวิธีใดๆ ในการประกอบกิจการค้าหรืออาชีพ ตามพระราชบัญญัติการพนัน พุทธศักราช 2487 เนื่องจากมูลค่าสินค้าที่ได้อาจจะมีมากกว่า เท่ากับหรือน้อยกว่าจำนวนเงินที่สั่งซื้อ หรือมีการใส่ของรางวัลอย่างอื่นเช่น บัตรกำนัล เงินสด โทรศัพท์มือถือ ทอง กุญแจรถยนต์เพื่อนำไปแลกรับรถยนต์ ฯลฯ ที่จะถือได้ว่าเป็นของรางวัลที่แถมพกลงไปในกล่องด้วย จึงเป็นการจัดให้มีการแถมพกหรือรางวัลด้วยวิธีการขายกล่องสุ่มสินค้า ซึ่งผู้ซื้อหรือผู้เล่นจะได้รับกล่องสินค้า แม้ทุกกล่องจะได้รับสินค้าและของแถมพกหรือรางวัล ในทุกกล่องก็ตาม แต่เมื่อผู้ซื้อไม่ทราบว่าตนจะได้สินค้าหรือของแถมพกหรือรางวัลชนิดใด ประเภทใด หรือจะได้รับสินค้าที่มีมูลค่าน้อยกว่า เท่ากับหรือมากกว่าจำนวนเงินที่จ่ายไปหรือไม่ อันเป็นการเสี่ยงโชคโดยวิธีใด ๆ จึงต้องได้รับอนุญาตจากเจ้าพนักงานผู้ออกใบอนุญาต ซึ่งหากไม่พบว่า กิจกรรมดังกล่าวได้รับอนุญาตจากเจ้าพนักงาน จะเป็นความผิดตามมาตรา 14 แห่ง พระราชบัญญัติการพนัน พุทธศักราช 2487 จึงเห็นสมควรว่าต้องมีการแก้ไขกฎหมายที่เกี่ยวข้องทั้งหมดที่บัญญัติความผิดแก่ผู้ที่มีการจัดให้มีการเล่นการพนันกล่องสุ่มสินค้าออนไลน์ และการจัดให้มีการแถมพกหรือรางวัลด้วยการเสี่ยงโชคโดยวิธีใด ๆ ในการประกอบกิจการค้าหรืออาชีพโดยไม่ได้รับอนุญาตรวมทั้งการบัญญัติพระราชบัญญัติเพื่อสร้างหลักเกณฑ์ หน่วยงานผู้รับผิดชอบ และการให้ความคุ้มครองแก่ผู้ซื้อกล่องสุ่มสินค้าออนไลน์ เพื่อให้การซื้อขายกล่องสุ่มสินค้าออนไลน์นั้นชอบด้วยกฎหมาย || A mystery box is a container filled to the brim with various things of various prices and styles. and gets sold The items within the package are unknown to the customer.
