| Abstract | ปัญหาอาชญากรรมยังคงเป็นปัญหาสำคัญในทุกสังคม เนื่องจากการเปลี่ยนแปลงและการพัฒนาของสังคมโลก ทำให้รูปแบบการเกิดอาชญากรรมที่เกิดขึ้นมีความหลากหลาย มีวิธีการกระทำความผิดที่ซับซ้อน โดยนำเอาลักษณะเทคโนโลยีในรูปแบบต่าง ๆ มาผสมผสานกับการกระทำความผิดทำให้ยากต่อการบังคับใช้กฎหมาย และในบางครั้งมีการดำเนินการเป็นเครือข่าย โดยมีลักษณะการกระทำผิดที่เกี่ยวข้องกันในหลายด้าน จึงนำไปสู่รูปแบบของอาชญากรรมข้ามชาติอาชญากรรมข้ามชาติเป็นอาชญากรรมที่เกิดขึ้นคาบเกี่ยวมากกว่าหนึ่งรัฐ หรือกระทำผิดในหนึ่งรัฐ แต่มีการเตรียมการ วางแผน สั่งการ จากอีกรัฐหนึ่ง หรือความผิดดังกล่าวเกิดผลกระทบในอีกรัฐหนึ่ง มีมูลเหตุ และแผนประทุษกรรมที่แตกต่างจากอาชญากรรมโดยทั่วไป จำเป็นอย่างยิ่งที่จะต้องทำความเข้าใจถึงมูลเหตุจูงใจ รูปแบบการกระทำผิด การบังคับใช้กฎหมาย การป้องกัน และปราบปราม ที่มีลักษณะแตกต่างจากอาชญากรรมโดยทั่วไป รวมถึงเป็นภัยคุกคามต่อความสงบเรียบร้อย ความปลอดภัยในชีวิต และทรัพย์สินของประชาชน ทั้งนี้ในยุคปัจจุบันเป็นยุคที่ผู้คนสามารถเดินทางข้ามพรมแดนได้อย่างสะดวกและรวดเร็ว ทำให้ผู้คนสามารถทำธุรกรรมทางการเงินผ่านเครือข่ายอินเทอร์เน็ตได้ โดยไม่จำกัดสถานที่และเวลา รวมถึงยังเป็นยุคที่ผู้คนสามารถติดต่อสื่อสารกันได้อย่างใกล้ชิดโดยที่ไม่ต้องรู้จักกันผ่านชุมชนสื่อสังคมออนไลน์ จากสภาวะการเปลี่ยนแปลงที่เกิดขึ้นในครั้งนี้ จึงเป็นช่องทางให้อาชญากรใช้ประโยชน์ในการกระทำผิด เพื่อมุ่งประสงค์ต่อทรัพย์สินของพลเมืองโลกในยุคดิจิทัลได้ทั้งภายในรัฐและระหว่างรัฐ || Crime is still a major problem in every society. By combining various forms of technology with the crime. This makes it difficult to enforce the law. and sometimes it is operated as a network The nature of the offenses is related in many aspects. thus leading to a form of transnational crime. Transnational crimes are crimes that occur in more than one state. or committed an offense in one state But there is preparation, planning, and ordering from another state. or the offense has consequences in another state and has a cause and plan of commission that is different from crimes in general. It is important to understand the underlying motives. Pattern of offense Law enforcement, prevention and suppression that are different from general crimes. including a threat to peace and order life safety and public property. Today is an era where people can travel across borders easily and quickly. It allows people to conduct financial transactions via the internet network.
