| Abstract | Despite Thailand’s increasing interest in developing its space sector, the country still lacks a clear domestic legal framework governing space activities, creating legal uncertainty regarding the regulation and supervision of space activities, particularly in relation to the State’s responsibility and liability under international space law. For the purpose of this study, a private spaceport generally refers to a spaceport owned, operated, or managed by a non-governmental entity, regardless of its ownership structure. This study evaluates based on the limitations of transplanting traditional Thai aviation law into the space sector. The United States is also used as a comparative model because its regulatory system provides one of the most comprehensive frameworks for spaceport licensing and operations. By comparing the two systems, this study seeks to identify key challenges for Thailand such as the absence of a clear regulatory authority, limited institutional capacity, and the lack of specific legal provisions governing spaceports. The study concludes that Thailand should establish a designated authority, clear legal definitions, and adopt a phased regulatory approach before allowing private participation in the spaceport sector. |
