Abstract | This research aims to study the process of amending the constitution according to the Constitution of the Kingdom of Thailand, to study and analyze the methods of obtaining constitutional provisions that create political imbalance. and to find a guideline for amending the Constitution of the Kingdom of Thailand B.E. 2560 to create political balance. This is research of documents such as parliamentary meeting reports and academic documents from Thailand and abroad on the amendment of the Thai constitution compared with the amendment of the Constitution of the French Republic, the amendment of the Basic Law of the Federal Republic of Germany, and the amendment of the Constitution of Japan. The research study found that amending the constitution according to the Constitution of the Kingdom of Thailand B.E. 2560 is more difficult than amending the Thai constitution in the past. As a result, provisions of the constitution that are not consistent with the changing political situation are not amended, resulting in political imbalance. Amending the Constitution of the French Republic, the Basic Law of the Federal Republic of Germany, and the Constitution of Japan are more difficult than amending the Thai Constitution, but the amendments to the Constitutions of all three countries are carried out with political balance in mind. Therefore, the method of amending the constitution of all three countries have been used as a guideline for studying the method of amending the Constitution of the Kingdom of Thailand B.E. 2560 to create political balance. To be successful, the parliament and the people must have the same opinion that the provisions of the constitution that are being amended have principles and reasons that make it necessary to amend because the purpose is to create political balance that benefits the people and the country more than the benefits of political parties, members of the House of Representatives and members of the Senate. The approach to make political parties, members of the House of Representatives, members of the Senate, and the public have the same opinions is to have a group of politically neutral individuals who have knowledge and expertise in public law, political science, or public administration, and who have experience in politics, public administration, or constitution drafting, which the National Assembly or the cabinet has set up as a committee to consider, study, listen to opinions, and hold public hearings to summarize issues that need to be amended, draft Constitution Amendment, and propose guidelines for amending the constitution so that political institutions and organizations under the constitution are more modern and balanced. |
